3. Purchases & NFT Policy

3.1 Nature of NFTs

All products offered on the Service are NFTs (Non-Fungible Tokens).

Each NFT:

  • Is a unique, irreplaceable digital asset;
  • Is permanently recorded on the blockchain;
  • Represents a digital artwork along with usage rights to the image;
  • Does not equate to the transfer of full intellectual property rights of the artwork, unless otherwise agreed in writing.

3.2 Rights Granted to NFT Owners

Upon purchase and legitimate ownership of an NFT, the buyer is granted limited usage rights to the image associated with the NFT, including:

a. Personal Use (Free)

NFT owners have the right to use the image for personal, non-commercial purposes, including but not limited to:

  • Collecting and personal display;
  • Displaying in digital wallets, virtual galleries, or virtual spaces;
  • Sharing on social media for non-profit purposes.

b. Commercial Use (Conditional)

NFT owners are permitted to use the image for commercial purposes, provided that:

  • 12% of revenue generated from such commercial exploitation must be allocated to the artist's family;
  • The revenue-sharing percentage, payment method, and reporting mechanism will be:
    • Specified in the metadata of each NFT; or
    • Announced in separate documents, agreements, or policies issued by the Company.

Failure to fulfill the revenue-sharing obligation is considered a serious violation of these Terms.

3.3 Prohibited Actions

NFT owners shall not:

  • Claim or imply ownership of the full copyright of the artwork;
  • Copy, distribute, sublicense, or transfer usage rights beyond the granted scope;
  • Use the image for illegal, offensive, defamatory purposes, or to harm the reputation or dignity of the artist and the artist's family.

3.4 Payments & Transactions

The buyer confirms that:

  • They have the legal right to use the provided payment method;
  • All transaction information is accurate and complete.

We reserve the right to refuse or cancel transactions in cases of detected fraud, unauthorized transactions, or technical errors.

4. Promotions

Any promotions, contests, or events (if applicable) may be governed by separate terms. In case of conflict, the specific terms of the promotion shall prevail.

5. Refund Policy (NO REFUND)

Due to the unique nature of NFTs as non-fungible digital assets, permanently and irreversibly recorded on the blockchain, all NFT purchase transactions are final.

👉 NO REFUNDS APPLY under any circumstances, including but not limited to:

  • Buyer's change of mind after transaction completion;
  • Market value fluctuations of the NFT;
  • User errors such as incorrect wallet address input or transaction mistakes.

By purchasing an NFT, you confirm that you have read, understood, and agree to this no-refund policy.

6. Content

All content on the Service is owned by Cong Quoc Ha or used legally under agreement. Any unauthorized copying or use is strictly prohibited.

7. Prohibited Conduct

You may not use the Service for any illegal, fraudulent, harmful purposes, or to infringe upon the rights of third parties.

8. Analytics & Tracking

We may use third-party analytics services to improve user experience.

9. Age Requirement

The Service is intended for users aged 18 and above. By using the Service, you confirm that you meet this requirement.

10. Accounts

You are responsible for maintaining the security of your account information and for all activities that occur under your account.

11. Intellectual Property

The Service and its components are the exclusive property of Cong Quoc Ha and related licensors.
